These Terms & Conditions (“Terms”) govern your use of the services provided by Samantha Cafiero (“Samantha,” “we,” “us,” or “our”), including our website, concierge and related services, and our SMS/text messaging programs (collectively, the “Services”).

By using our Services, submitting information to us, or opting in to receive SMS/text messages from us, you agree to these Terms. If you do not agree, do not use the Services.

1. Use of Our Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for:

Not using the Services for any fraudulent, abusive, or harmful purpose

2. SMS/Text Messaging Program (A2P 10DLC)

We may provide one or more SMS/text messaging programs for:

Booking confirmations and updates

Service and appointment reminders

Customer support communications

Occasional informational or promotional messages, where permitted

We strive to comply with applicable U.S. laws and industry guidelines, including TCPA and CTIA standards, for SMS communications.

2.1 Opt-In

You will only receive SMS/text messages from us if you affirmatively opt in, for example by:

Submitting a web form and agreeing to receive text messages

Texting a keyword to a number we designate

Checking a consent box and providing your mobile number

Providing written or verbal consent where recorded as allowed by law

By opting in, you consent to receive SMS/text messages at the mobile number you provide, which may include the use of automated dialing technology where permitted by law.

2.2 Message Frequency

Message frequency may vary depending on your interactions with us, the services you request, and ongoing communication needs. We aim to send only messages that are reasonably related to your relationship with us.

2.3 Opt-Out

You may opt out of receiving SMS/text messages from us at any time by replying with:

“STOP” (recommended), or

“CANCEL,” “UNSUBSCRIBE,” or “QUIT” (if supported by your carrier)

After you send STOP, we may send a single confirmation message stating that you have been unsubscribed. You will not receive further SMS/text messages from that specific program unless you re-enroll.

2.5 Costs and Carriers

Message and data rates may apply to any messages sent to or from you, depending on your mobile carrier and plan.

You are responsible for any charges billed by your carrier.

Mobile carriers may process message metadata and usage information in the normal course of delivering SMS; such processing is subject to each carrier’s own terms and privacy policies.

Carriers are not liable for delayed or undelivered messages.

2.6 Eligibility

By using the SMS program, you represent that you:

Are the subscriber or authorized user of the mobile number you provide, and

Are at least 18 years old or the age of majority in your jurisdiction, or have appropriate parental/guardian consent.

3. Data Use and No Sharing of Personal Information

We respect your privacy and limit our use of your information.

We do not sell, rent, or share your personal information (including your name, email, phone number, or SMS opt-in data) with third parties for their own marketing, advertising, or independent use.

Your information is used solely to provide and manage the Services, communicate with you, and comply with legal obligations, as described in our Privacy Policy.

We do not grant any third party the right to use your personal information for their own purposes.

If we are ever legally required to disclose certain information (for example, to comply with a court order or lawful request from a government authority), we will do so only to the extent required by law.

4. Bookings, Payments, and Cancellations

Specific terms regarding pricing, payment, deposits, refunds, and cancellations may be set forth in:

By requesting or accepting Services, you agree to pay all applicable fees and charges in accordance with the payment terms provided. Cancellation and rescheduling policies may apply and may include fees if deadlines are not met.

5. Intellectual Property

All content and materials provided via the Services, including text, graphics, logos, images, and layouts, are owned by or licensed to us and protected by applicable intellectual property laws.

You agree not to:

Copy, reproduce, modify, or create derivative works of any part of the Services without prior written consent

Use any trademarks, logos, or branding belonging to us without permission

6. Prohibited Conduct

You agree that you will not:

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that messages will always be delivered in real time or at all.

8. Limitation of Liability

To the fullest extent permitted by law:

Samantha Cafiero and any employees, agents, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Services or these Terms, whether based in contract, tort, or otherwise.

Our total liability for any claim arising out of or relating to the Services or these Terms shall not exceed the amount you paid to us for the specific Service giving rise to the claim, if any.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those cases, our liability will be limited to the minimum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Samantha Cafiero and any employees, agents, or affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your continued use of the Services after any changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms and any disputes arising out of or relating to them or to the Services shall be governed by and construed in accordance with the laws of the state in which Samantha Cafiero principally operates, without regard to its conflict of laws rules, except where otherwise required by applicable law.
